The terms “we,” “us,” and “our” refer to Creative Panda Creature. We operate this store and website, including all related information, content, features, tools, products, and services, to provide you, the customer, with our online store and shopping experience (the “Services”). The Services are powered by Shopify.

These Terms of Service (together with any policies referenced herein, such as our Shipping Policy, Returns Policy, and Privacy Policy) describe your rights and responsibilities when you use the Services.

Please read these Terms carefully, as they contain important information about your legal rights, including warranty disclaimers, limitations of liability, and consumer rights under EU law.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy.  If you do not agree, please do not use or access the Services.

SECTION 1 - ACCESS AND ACCOUNT 
By using our Services, you confirm that you are at least the age of majority in your country of residence, and that you consent to allow any minor dependents to use the Services on devices you own or manage, in compliance with applicable laws.

To use the Services, including browsing our online store or purchasing products, you may be asked to provide certain information such as your email address, billing, payment, and shipping information. You confirm that all information you provide is accurate, current, and complete, and that you have the necessary rights to provide it.

You are solely responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You may not transfer, sell, assign, or license your account to any other person.

All product descriptions, prices, and availability are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product or limit quantities at our discretion, including by person, geographic region, or jurisdiction.

Please note that some products may only be available in certain countries, and international shipping restrictions or customs requirements may apply.

SECTION 3 - ORDERS

When you place an order, you are making an offer to purchase products from Creative Panda Creature. We reserve the right to accept or decline your order at our discretion. Your order is not accepted until we confirm acceptance and process your payment.

Please review your order carefully before submitting, as we may be unable to accommodate cancellation requests after an order is accepted, except as required under applicable consumer protection laws. For EU consumers, you retain statutory rights to cancel certain purchases within 14 days for non-custom items.

In the event that we do not accept, modify, or cancel an order, we will notify you using the email, billing address, and/or phone number provided at the time of purchase.

Your purchases are subject to return or exchange only in accordance with our Refund Policy.

You represent and warrant that your purchases are for your personal or household use only and not for commercial resale, unless explicitly agreed. International orders may be subject to export restrictions, customs, and import duties in your country.


SECTION 4 - PRICES AND BILLING

Prices: All prices are displayed in the currency corresponding to your location. Prices for products include VAT where applicable, unless otherwise stated.
Shipping, Customs, and Fees: Shipping, handling, customs, and import duties may apply and will be shown before checkout. You are responsible for any additional charges that may apply in your country.


Promotions & Discounts: Prices, discounts, and promotions may change from time to time. Promotional terms may apply separately and will take precedence if there is any conflict.


Payment Authorization: By completing a purchase, you confirm that you are authorized to use the selected payment method and that all information provided (e.g., card details, billing address) is accurate. You agree to pay the total order amount, including product price, shipping, taxes, and any applicable fees.


Order Confirmation: The price charged will be the price displayed at checkout and confirmed in your order confirmation email.

Note: Prices displayed on our website may differ from prices in physical stores or other online stores operated by third parties.

SECTION 5 - PAYMENT METHODS

We want your checkout experience to be easy and secure. We currently accept the following payment methods:

1. Credit & Debit Cards
We accept major credit and debit cards, including Visa, MasterCard, and American Express.
All card payments are processed securely via our payment provider.
By using your card, you confirm that you are authorized to use it and that the billing information is accurate.

2. PayPal
You can pay using your PayPal account for a fast and secure checkout.
PayPal payments are processed according to PayPal’s terms and conditions, and funds are transferred immediately upon purchase.

Payment Security
All payments are processed through secure, encrypted channels.
We do not store your full credit card information on our servers.

Note: Your order will be processed once payment is successfully completed. Prices, shipping, and taxes will be finalized at checkout.


SECTION 6 - SHIPPING AND DELIVERY

We are not liable for shipping or delivery delays. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, or other events outside our control. Once we hand your products over to the carrier, the risk of loss or damage passes to you.

Unless otherwise agreed, we will deliver the goods without undue delay and no later than 30 days from the conclusion of the contract.

If we fail to deliver within this period, you may request delivery within an additional reasonable period. If we fail to deliver within that additional period, you have the right to withdraw from the contract and receive a full refund.

This does not apply if we have expressly informed you that delivery within a certain time is essential.

RISK OF LOSS

For consumers within the European Union, the risk of loss or damage to goods passes to you only when you or a third party designated by you (other than the carrier) take physical possession of the goods.

If you arrange your own carrier independent of us, the risk passes to you upon handover to that carrier.

For business customers, the risk passes upon delivery of the goods to the carrier.


SECTION 7 - INTELLECTUAL PROPERTY

Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video, and audio, as well as the design, selection, and arrangement thereof, are owned by Creative Panda Creature, its affiliates, or licensors and are protected by EU, Czech, and international copyright, trademark, and other intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material from the Services without our prior written consent. Except as expressly provided herein, nothing in these Terms grants or shall be construed as granting a license or other rights to you under any patent, trademark, copyright, or other intellectual property of Creative Panda Creature, Shopify, or any third party. Unauthorized use of the Services may violate applicable intellectual property laws.

Trademarks:
Creative Panda Creature’s names, logos, product and service names, designs, and slogans are trademarks of Creative Panda Creature or its affiliates or licensors. You must not use such trademarks without prior written permission.

Shopify’s name, logo, product and service names, designs, and slogans are trademarks of Shopify.

All other names, logos, product and service names, designs, and slogans on the Services are the trademarks of their respective owners.

SECTION 8 - OPTIONAL TOOLS 

As part of the Services, you may be provided access to optional tools offered by third parties. We do not monitor, control, or endorse these tools and provide access “as is” and “as available” without any warranties, representations, or conditions of any kind.

You acknowledge and agree that any use of third-party tools is at your own risk. We shall have no liability arising from or relating to your use of optional third-party tools.

Before using any optional tools, you should review and understand the terms, conditions, and privacy policies provided by the third-party provider(s).

We may also introduce new features or tools in the future. Any such new features will be considered part of the Services and are subject to these Terms of Service.

If you choose to leave the Services to visit third-party sites, you do so at your own risk. We are not responsible or liable for any harm, loss, or damages resulting from your access to or use of third-party websites, products, services, or content.

Before engaging with any third-party site, you should carefully review and understand their terms, privacy policies, and practices. Any complaints, claims, or questions regarding third-party products or services should be directed directly to the third-party provider.

SECTION 10 - RELATIONSHIP WITH SHOPIFY
Creative Panda Creature is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Creative Panda Creature. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Creative Panda Creature, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Creative Panda Creature.

SECTION 11 - PRIVACY POLICY

All personal information we collect through the Services is subject to our Privacy Policy. Some personal information may also be subject to Shopify’s Privacy Policy. By using the Services, you acknowledge that you have read and understand these privacy policies.

Because the Services are hosted by Shopify, Shopify may collect and process personal information about your access to and use of the Services in order to provide, operate, and improve the Services. Information you submit to the Services may be transmitted to and shared with Shopify as well as other third-party service providers, which may be located outside your country of residence, including outside the European Economic Area (EEA).

By submitting Feedback, you represent and warrant that:

  2. You have disclosed any compensation or incentives received in connection with the Feedback; and

  3. Your Feedback complies with these Terms, including all applicable laws.

We have no obligation to:

  • Maintain your Feedback in confidence;

  • Pay compensation for your Feedback; or

  • Respond to your Feedback.

We may, but are not required to, monitor, edit, or remove Feedback that we determine in our sole discretion to be unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene, otherwise objectionable, or that violates any party’s intellectual property or these Terms.

You agree that your Feedback will not:

  • Violate any third-party rights, including copyright, trademark, privacy, or other proprietary rights;

  • Contain libelous, unlawful, abusive, obscene content, or malware; or

  • Misrepresent your identity or use a false email address.

You are solely responsible for the accuracy and legality of your Feedback. We assume no responsibility or liability for any Feedback posted by you or any third party.

SECTION 13 - ERRORS, INACCURACIES AND OMISSIONS

Occasionally, the Services may contain typographical errors, inaccuracies, or omissions that relate to product descriptions, pricing, promotions, offers, shipping charges, transit times, or availability. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information, or to cancel orders if any information is inaccurate, at any time and without prior notice (even after you’ve submitted your order).

If there is an error in pricing or product information that affects your order, you will be notified, and you may be given the option to confirm, modify, or cancel your order, in accordance with your rights under EU consumer law.


SECTION 14 - PROHIBITED USES

You may access and use the Services for lawful purposes only. You agree not to use the Services, directly or indirectly, to:

  2. Violate any applicable laws, regulations, or local ordinances (whether international, federal, provincial, state, or local);

  8. Engage in any activity that restricts or inhibits others' use of the Services or which may harm Creative Panda Creature, Shopify, or any users, or expose them to liability.

In addition, you agree not to:

  1. Upload or transmit viruses or malicious code that could harm the Services or any connected systems;

  2. Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Services without our express permission;

  3. Collect or track personal information of others, in violation of our Privacy Policy and data protection laws;

  4. Engage in any forms of scraping, phishing, spamming, or other harmful activities (including “spiders,” “crawlers,” or other automated methods);

  5. Interfere with or bypass security features of the Services or any related websites, other websites, or the Internet.

We reserve the right to suspend, disable, or terminate your account at any time, without notice, if we determine that you have violated any part of these Terms. Any violations of intellectual property or consumer protection laws may lead to immediate action to protect the rights of our business and users.


SECTION 15 - TERMINATION

We may terminate this agreement or your access to the Services (or any part of them) in our sole discretion at any time, with or without notice. However, you will remain liable for all amounts due up until and including the date of termination.

For EU consumers, please note that termination of your access to the Services will not affect any rights you have under applicable consumer protection laws, including the right to a refund or cancellation in certain circumstances, as outlined in our Refund & Returns Policy.

We disclaim all liability and responsibility arising from any reliance placed on such materials by you or any other visitor to the Services, or by anyone who may be informed of any of its contents.

EXCEPT AS EXPRESSLY STATED BY Creative Panda Creature, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" FOR YOUR USE, WITHOUT ANY REPRESENTATION, WARRANTIES, OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE, REPRESENT OR WARRANT THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. SOME JURISDICTIONS LIMIT OR DO NOT ALLOW THE DISCLAIMER OF IMPLIED OR OTHER WARRANTIES, SO THE ABOVE DISCLAIMER MAY NOT APPLY TO YOU.

EU Consumers – Legal Warranty Rights:

For all physical products sold to EU consumers, you are entitled to a 2-year legal warranty for defects under EU consumer protection law. If your product is found to be defective, you are entitled to repair, replacement, or refund at no additional cost to you.

This legal warranty is applicable if the product shows defects within 2 years of receipt. You should inform us of the defect within a reasonable time after discovering it.

Made-to-Order and Custom Products:

For custom or made-to-order items, we provide coverage for defects or errors in production. However, non-defective customization (such as personalized elements) cannot be returned or exchanged.

This legal warranty is in addition to your statutory rights as a consumer under EU law, and it does not affect your rights to request a repair, replacement, or refund for defective goods.

SECTION 17 – RIGHT OF WITHDRAWAL (EU CONSUMERS)

Right of Withdrawal

If you are a consumer residing in the European Union, you have the right to withdraw from this contract without giving any reason within 14 days.

The withdrawal period expires 14 days after:

  • the day on which you, or a third party indicated by you (other than the carrier), acquire physical possession of the goods; or

  • in the case of multiple goods ordered in one order but delivered separately, the day on which you acquire physical possession of the last item.

How to Exercise the Right of Withdrawal

To exercise your right of withdrawal, you must inform us of your decision by a clear statement (e.g., email or letter).

To meet the withdrawal deadline, it is sufficient for you to send your communication before the 14-day period has expired.

Effects of Withdrawal

If you withdraw from this contract:

  • We will reimburse all payments received from you, including standard delivery costs (excluding additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us).

  • We will make the reimbursement without undue delay, and no later than 14 days from the day we receive your withdrawal notice.

  • We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is earlier.

  • We will use the same means of payment you used for the initial transaction, unless expressly agreed otherwise.

Returning the Goods

You must send back the goods without undue delay and no later than 14 days from the day you notify us of your withdrawal.

The deadline is met if you send back the goods before the 14-day period has expired.

You will bear the direct cost of returning the goods unless otherwise agreed.

You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

Exceptions to the Right of Withdrawal

The right of withdrawal does not apply to:

  • Goods made to the consumer’s specifications or clearly personalized;

  • Goods which are liable to deteriorate or expire rapidly;

  • Sealed goods not suitable for return due to health protection or hygiene reasons if unsealed after delivery.

(Custom-made crochet items fall under the personalized goods exception.)

SECTION 18 – COMPLAINT PROCEDURE (REKLAMAČNÍ ŘÁD)

This complaint procedure applies to consumer contracts governed by Czech law.

1. Legal Basis

Consumers are entitled to rights arising from defective performance in accordance with:

  • Act No. 89/2012 Coll., Civil Code

  • Act No. 634/1992 Coll., on Consumer Protection

  • Relevant EU directives

2. Liability for Defects

We are liable to consumers that goods are free from defects upon receipt.

If a defect becomes apparent within 12 months from receipt, the goods are presumed to have been defective at the time of delivery unless proven otherwise.

The consumer may exercise rights from defective performance within 24 months from receipt of the goods.

3. Consumer Rights in Case of Defect

In case of defective goods, the consumer may request:

  • Repair of the goods;

  • Replacement with new goods;

  • A reasonable price reduction; or

  • Withdrawal from the contract (if defect is substantial or repeated).

5. Complaint Handling Time

Complaints will be resolved without undue delay, no later than 30 days from the date the complaint is filed, unless we agree on a longer period.

You will be informed about the outcome by email or phone.

SECTION 19 - LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT SHALL Creative Panda Creature, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, OR LICENSORS, OR THOSE OF Shopify AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF ANY OF THE SERVICES OR ANY PRODUCTS PROCURED USING THE SERVICES.

This includes, but is not limited to, errors or omissions in any content, or any loss or damage incurred as a result of the use of the Services or any content or product posted, transmitted, or otherwise made available via the Services, even if Creative Panda Creature has been advised of the possibility of such damages.

However, nothing in this section will limit or exclude our liability in cases of:

  1. Death or personal injury caused by our negligence;

  2. Fraud or fraudulent misrepresentation;

  3. Breach of your statutory rights under applicable consumer protection laws; or

  4. Any liability that cannot be excluded or limited under EU or applicable national laws.


SECTION 20 - INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Creative Panda Creature, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims, including reasonable attorneys’ fees, payable to any third party arising out of:

  1. Your breach of these Terms of Service or any documents incorporated by reference;

  2. Your violation of any applicable law or the rights of a third party;

  3. Your access to and use of the Services.

We will notify you of any indemnifiable claim. However, failure to promptly notify will not relieve you of your indemnification obligations unless you are materially prejudiced by such delay.

We may control the defense and settlement of such claims at your expense, including the choice of counsel, but will not settle any claim that requires you to take on non-monetary obligations without your prior consent (which shall not be unreasonably withheld).

You agree to cooperate in the defense of any indemnified claims, including by providing relevant documents and assisting in any reasonable way.

Note for EU consumers: These indemnification provisions are subject to your statutory consumer rights under applicable law. You cannot be required to indemnify us for claims that are related to any breach of your statutory rights as a consumer.


SECTION 21 - SEVERABILITY

If any provision of these Terms of Service is found to be unlawful, void, or unenforceable, such provision shall be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion will be deemed to be severed from these Terms.

However, this severance will not affect the validity or enforceability of the remaining provisions.

Note for EU consumers: This provision does not affect your statutory consumer rights, which are always protected under applicable law.


SECTION 22 - WAIVER; ENTIRE AGREEMENT

The failure of Creative Panda Creature to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Services constitute the entire agreement and understanding between you and us regarding your use of the Services, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

Note for EU consumers: Nothing in this section shall affect your statutory rights under applicable EU consumer protection law.

SECTION 23 – OUT-OF-COURT DISPUTE RESOLUTION

In the event of a consumer dispute, the consumer has the right to out-of-court dispute resolution.

We are not obligated to participate in dispute resolution before an ADR entity unless required by law, but we will consider participation on a case-by-case basis.


SECTION 24 - ASSIGNMENT

You may not delegate, transfer, or assign this Agreement or any of your rights or obligations under these Terms without our prior written consent, and any such attempt will be null and void. We may transfer, assign, or delegate these Terms and our rights and obligations without consent or notice to you.

Note for EU consumers: Nothing in this section will restrict or limit your rights under applicable EU consumer law, including your right to transfer rights in relation to the services you’ve purchased.


SECTION 25 - GOVERNING LAW

These Terms of Service and any separate agreements under which we provide you Services shall be governed by and construed in accordance with the laws of the Czech Republic.

However, for EU consumers, any disputes arising out of or in connection with these Terms shall be subject to the mandatory jurisdiction and venue granted by EU consumer protection law, which may allow you to bring a claim in your home country or jurisdiction.

Any disputes will be subject to the exclusive jurisdiction of the courts of the Czech Republic, unless mandatory EU consumer protection law grants you a different venue.

We reserve the right, in our sole discretion, to update, change, or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes.
